Terms of service

These Terms of Service ("Terms") apply to your use of odat.us (the "Site") and to any purchase you make from us. The Site is operated by ODAT ("ODAT," "we," "us" or "our"), based in North Las Vegas, Nevada. By using the Site or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy and Refund Policy, which are part of these Terms. If you don't agree, please don't use the Site.

1. Using the Site

You must be at least the age of majority where you live, or use the Site with the involvement of a parent or guardian. You agree to give us accurate information, to keep your account login secure, and to use the Site only for lawful, personal purposes. You may not misuse the Site, for example by trying to hack or disrupt it, scraping it, placing fraudulent orders, or buying products for unauthorized resale.

2. Made to order

Every ODAT product is made to order after you check out. Because each piece is produced individually, small variations in color, fabric texture and print or embroidery placement are normal and are not defects. Some images on the Site are digital renderings, including AI-generated imagery, created to show the design and fit. Actual colors and details may vary slightly from what you see on your screen.

3. Orders, pricing and payment

All prices are in U.S. dollars. Prices, products and availability can change at any time without notice. Your order is an offer to buy. We may accept, limit or cancel any order, for example if an item is unavailable, a price or description was listed in error, or we suspect fraud. If we cancel an order after you've been charged, we'll refund you in full. Applicable sales tax and shipping charges are shown at checkout before you pay.

Payments are processed by Shopify and its payment partners. We don't see or store your full card number. You confirm that you're authorized to use the payment method you provide.

4. Shipping, returns and refunds

Shipping times, defect claims, cancellations and refunds are covered in our Shipping Policy and Refund Policy.

5. Promotions

Discount codes and promotions have no cash value, can't be combined unless we say so, and may end at any time. We may cancel orders that misuse a promotion.

6. Our brand and content

The ODAT name, the Horizon mark, our logos, designs, photos, videos and text are owned by or licensed to ODAT and are protected by intellectual property laws. You may not copy, sell or use them without our written permission. Buying a product doesn't give you any rights to our brand or designs.

7. Reviews and content you send us

If you send us or post reviews, photos, comments or other content about ODAT, you confirm that it's yours to share, that it's truthful and reflects your real experience, and that it doesn't break any law or anyone else's rights. You give us a non-exclusive, royalty-free, worldwide license to use, display and share that content in connection with ODAT, with credit to you where practical. We'll ask before featuring your photos in ads. If you send us ideas or suggestions, we may use them without any obligation to you.

8. Third-party services and links

The Site is hosted by Shopify, and orders are produced and shipped by our production and shipping partners. The Site may link to websites or services we don't control. Your use of them is subject to their own terms, and we aren't responsible for them.

9. Privacy

10. Disclaimers

We work hard to keep the Site accurate and available, but we can't promise it will always be error-free, secure or uninterrupted. Except as stated in our Refund Policy, and to the fullest extent permitted by law, the Site and its content are provided "as is" and "as available," without warranties of any kind. Nothing in these Terms excludes or limits any warranty or consumer right that can't be excluded or limited under applicable law.

11. Limitation of liability

To the fullest extent permitted by law, ODAT and its owners, employees and partners won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the Site or any product. Our total liability for any claim related to a product or order is limited to the amount you paid for that order. Some states don't allow these limits, so they may not apply to you.

12. Indemnity

If you break these Terms or the law and that leads to a claim against ODAT, you agree to cover our reasonable costs of dealing with it, including attorneys' fees, to the extent permitted by law.

13. Governing law and disputes

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules. If you have a problem, please email us first at support@odat.us. Most issues can be fixed quickly. If we can't resolve it informally within 30 days, any dispute will be decided by the state or federal courts located in Clark County, Nevada, and you and we consent to their jurisdiction. Either of us may instead bring an individual claim in a small claims court that has jurisdiction. Nothing in this section limits any rights you have under the consumer protection laws of the state where you live.

14. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted here with a new "Last updated" date and applies to use of the Site and orders placed after that date.

15. Other terms

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce any part isn't a waiver. You may not transfer your rights under these Terms. We may transfer ours, for example as part of a reorganization or sale of the business. These Terms, together with the policies referenced above, are the entire agreement between you and us about the Site and your purchases.
